Parent Ordering Terms

1. Checking Your Order

Please check the student, photograph, pose, product, size, quantity, spelling and delivery details before making payment.

Because our products are personalized, selections normally cannot be changed or cancelled after production has begun. If you notice an error immediately after ordering, please contact us as soon as possible and we will try to assist before production starts.


2. Photographic Style and Appearance

Photography involves professional and creative judgment. This includes decisions concerning pose, expression, composition, cropping, lighting, colour, contrast and finishing.

Photographs taken in different years, locations or lighting conditions may not look identical. Differences in expression, pose, hairstyle, uniform, appearance or photographic style do not by themselves mean that the photograph is defective.

We will, however, investigate genuine technical or production issues, including photographs supplied for the wrong student, incorrect products, damaged prints or material processing errors.


3. Image Previews

Images displayed in the online gallery may be resized, compressed or watermarked for security and viewing purposes. These previews are intended to help with image selection and may not represent the full resolution of the final product.

Final images may receive normal production adjustments, including cropping, exposure correction, colour correction and preparation for the selected print size.


4. Retouching

Standard processing may include reasonable adjustments to exposure, colour, contrast, cropping and background presentation.

Extensive retouching—such as changing facial features, body shape, hairstyle, clothing or removing permanent physical characteristics—is not included unless specifically offered and requested.

MyPortrait will not materially alter a student’s identity or appearance without appropriate instruction and authorisation.


5. Print and Screen Differences

Colours and brightness may appear differently between phones, computers and printed products because screens, papers and printing processes reproduce colour differently.

Minor variations in colour, brightness, cropping, positioning or print batches are normal and are not necessarily production defects.


6. Personalised Products, Cancellations and Refunds

Orders containing personalised photographs or products cannot normally be cancelled for a change of mind after production has begun.

Digital products cannot normally be refunded after they have been downloaded or accessed, unless the file supplied is incorrect or defective.

Nothing in these terms limits any rights or remedies available to consumers under Malaysian law.


7. Delivery

Any delivery or school-distribution date provided is an estimate. Delivery may be affected by school schedules, incomplete student information, courier delays, public holidays or other circumstances outside MyPortrait’s reasonable control.

Parents are responsible for providing accurate contact and delivery information. Please notify us promptly if an order has not arrived within the expected period.


8. Reporting a Problem

Please report any issue within 14 days after receiving your order. Include:

- The order number;

- The student’s name and school;

- A description of the issue; and

- Clear photographs of the product, packaging or printing problem where applicable.

Reporting an issue promptly allows us to check the relevant production records and files. Delayed reports may limit the remedies available where working files or production records are no longer retained.

This reporting period does not remove any statutory rights that cannot legally be excluded.


9. Corrections, Replacements and Refunds

When a verified error or defect has occurred, MyPortrait will provide an appropriate remedy depending on the circumstances. This may include correcting a digital file, reprinting or replacing the affected product, or issuing a full or partial refund.

We may ask for the affected product to be returned or for supporting photographs before arranging a replacement or refund.


10. Image and File Retention

MyPortrait does not provide permanent archival storage.

Unless a different period has been agreed with the school:

- RAW files, unselected photographs and working production files may be deleted 90 days after the gallery closes or the project is completed; and

- Purchased final images and associated order records may be retained for up to 12 months after fulfilment.

After the relevant retention period, MyPortrait cannot guarantee that an image can be recovered, re-edited, compared or reproduced.

Files may also be deleted earlier where required for privacy, security, consent withdrawal or legal compliance.


11. Digital-image Usage

Purchased digital images are supplied for the customer’s personal, non-commercial use. Customers may download, store, share and print the images for personal or family purposes.

Copyright remains with MyPortrait unless otherwise agreed in writing. Images may not be resold, commercially licensed, materially altered for misleading purposes or used to represent another photographer’s work.

MyPortrait will not use an identifiable student’s photograph for advertising or public promotional purposes without the appropriate separate permission.


12. Student Information and Privacy

MyPortrait processes student and parent information for purposes such as organising picture day, matching photographs, providing secure galleries, fulfilling orders and providing customer support.

13. School Information and Cooperation

MyPortrait may rely on student names, classes, identification numbers, schedules and other information supplied by the school or parent.

We will take reasonable steps to correct an order affected by inaccurate or incomplete information, but fulfilment may be delayed while the correct information is confirmed.


14. Events Outside Our Control

MyPortrait is not responsible for delays or inability to provide services caused by circumstances outside our reasonable control, including school closures, severe weather, illness, equipment failure, courier disruption, internet outages or restrictions imposed by the school.

Where reasonably possible, we will offer an alternative arrangement or communicate the next available option.


15. Contact and Resolution

If you have a concern, please contact MyPortrait using the customer-service details shown on the website or your order confirmation.

We will review the order, relevant photographs and production records and aim to provide a clear response within [five] business days.

These terms are governed by the laws of Malaysia. Nothing in these terms prevents a customer from exercising any right available under applicable Malaysian consumer law.
